When spouses separate, one of the most stressful issues they face involves what will happen to the children, who will care for them, where they will live (the parenting schedule), and how to support them (normally calculated by the North Carolina Child Support Guidelines). Child Custody and Visitation
When spouses separate, one of the spouses may need financial support from the other spouse. In North Carolina, we call this post separation support (temporary alimony) for the short term, and then alimony for a longer duration. Whether a client is entitled to such financial support depends on many factors under North Carolina law, and in large part depends on their standard of living and their respective incomes and monthly needs/expenses. Adoption
Stepparent means an individual who is a spouse of a parent of a child, but who is not a legal parent of the child. N.C.G.S. § 48-1-101(18). In a stepparent adoption, the stepparent is the petitioner, whereas the parent of the child (stepparent’s spouse) consents to the adoption.
Premarital Agreement
In John’s family law practice, he has extensive experience with all aspects of a domestic dispute – from preparing premarital agreements and separation agreements, to mediation or arbitration, to numerous trials and appeals. Real Estate Litigation
Another frequent disagreement involves allegations of misrepresentations. When a seller lists her home, a seller generally has to complete and sign a disclosure statement. The seller should be very careful in filling out this document, and should consult with the listing agent to make sure that there are no misrepresentations. The law imposes on sellers the duty to avoid making misrepresentations when selling their home. At the same time, the law imposes on buyers the duty to use due diligence and to inspect the home. Our firm often handles disputes where there are allegations that the seller lied about their property, and we have to help determine if a misrepresentation was made and/or if the buyer used appropriate due diligence or reasonably relied on the seller’s statement. This issue more often than not comes up after closing, and later the buyer discovers a problem or defect with the home and believes the seller knew about the problem but did not reveal it. These defects are varied, but often involve property problems with water intrusion, leaks, plumbing, HVAC, mold or mildew, boundary disputes, fence encroachments, a developer’s planned use of natural areas, and even HOA assessments.
