Professionalism

Bischoff and his associates are deceitful, unscrupulous, exploitative leeches. In dealing with the settling of an estate, his office continued to send letters claiming (supposedly on behalf of Henrico County) that I owed his office money (with no explanation whatsoever detailing the amounts supposedly owed) when the estate in question had been settled appropriately with all forms, paperwork, etc. clearly filled out, sticky-note labeled, and submitted. The lack of justification for his harassment and the absurd "ASAP" deadlines (which would, many months later, produce more letters from him demanding additional payments) demonstrate the inauthenticity of his work on behalf of the county government and his lack of respect and appropriateness in dealing with its citizens.

If you have any personal belief in right and wrong at all, I implore you not to give support to this arrogant, parasitic scumbag.

Child Support
NOTE: This statute was amended effective July 1, 2017, for decedent’s dying on or after that date, and the statute adds child support arrearages as class 8 claims, moves “debts and taxes due localities” to class 9, and “all other claims” to class 10.
Adoption
Guardianship
Costs of administration of the guardianship, which includes qualification costs, surety premiums, filing costs for the Commissioner of Accounts, “reasonable compensation” to the guardian and other administrative costs are proper disbursements from the assets of the minor.

Identity Theft
Do not list the full account number for any account shown on the inventory. List only the last four (4) digits of each account. Identity theft protection is strongly suggested. Do not disclose the full account number on any document to be filed with the Court. These documents, once approved by the Commissioner of Accounts, are recorded and published on the Henrico Circuit Court public records and are available to anyone who searches the public records. While the Commissioner of Account’s office attempts to correct accountings listing full account numbers, we do not guarantee that those account numbers in all circumstances are corrected. It is your obligation to properly list all accounts by the last four (4) digits.

Real Estate Transactions
Restricted power of sale, the incapacitated’s interest in real estate should be listed in Part 3, at its tax assessed value. If the order requires the approval of the Commissioner of Accounts prior to closing of any real estate sale, the real estate is listed in Part 3, as your power of sale is restricted.

Personal Injury
The qualification of a guardian of the property of a minor may have to be made by petition to the Henrico County Circuit Court. If there is a contest between individuals seeking appointment as the guardian of the property of the minor, a Court hearing may be required, but this is normally not the case. This may also be necessary where a personal injury settlement is approved by the Henrico Circuit Court under which settlement the minor receives a monetary settlement.

Trusts and Estates

Estate Planning
The Commissioner’s of Accounts system has been part of the Virginia judicial system since 1849. The Commissioner acts as an arm of the Court by supervising the administration of various types of estates. Some states have Probate Courts which oversee all actions of the personal representative. Virginia uses the Commissioner of Accounts to aid the Court in the orderly accounting for estate administration.
Wills
For a trust created under the last will and testament of a decedent, qualification as trustee of the testamentary trust is required in the Clerk’s office of the Henrico Circuit Court, and in the absence of a properly executed waiver of accounting requirements, the trustee also has the duty to account to the Commissioner of Accounts. Qualification as trustee may be at the same time as qualification of the executor of the estate, or may occur at a later time when assets are ready to be distributed by the executor of the estate to the testamentary trustee.
Trusts
The trustee of a trust under agreement (also referred to as a Living Trust because it was created by the decedent before death and not created in the will) is not required to account to the Commissioner of Accounts and is not required to qualify before the Court as trustee. (NOTE: There have been rare instances where the trust under agreement specifically requires the trustee to account to the Commissioner of Accounts, in which case accounting is required). The trustee of a trust under agreement is appointed by the person creating the trust and assumes his obligations upon the creation of the trust or a later date as specified by the trust document. He has an obligation to account to the trust beneficiaries, not the Commissioner of Accounts.
Power of Attorney
Jointly titled bank or brokerage accounts would also be listed in Part 5 if they pass by survivorship or transfer on death designation. The value of the incapacitated’s interest in the joint with survivorship bank or brokerage accounts is the percentage contribution made to the account by the incapacitated; except the whole value if jointly held by husband and wife. Note that a bank account jointly titled as a Power of Attorney or Attorney in Fact is not a survivorship account and should be listed in Part 1 if no POD designation has been stated on the account card signed by the incapacitated.
Probate

Foreclosure
There is no statutory form required to be used by a foreclosure trustee in reporting his actions and the application of proceeds from the sale under a foreclosure.

The Office of the Commissioner of Accounts does not advise on legal or tax issues or the interpretation of the testamentary document or intestate law under the statutes of Virginia. Each fiduciary should consult with an attorney qualified in the field of your responsibility for legal advice as to legal issues, or an accountant for tax advice or tax filings, when those specific issues are presented during the administration of an estate.
