Child Support
New Jersey has used child support guidelines in one form or another for over 20 years. The basic concept of using child support guidelines is that both parents' actual incomes or expected incomes are entered into a computer program, along with the number and ages of the children, the anticipated amount of time that the children are expected to spend overnight with each parent, and other factors. The concept is that by entering similar data from similar counties into a fixed program, the judiciary is able to create a system whereby children in all of New Jersey's 21 counties are treated equally.
Child Custody and Visitation
One can also file a Complaint with the Superior Court of New Jersey seeking child custody, child support, alimony (or all three) without also filing for divorce.
Guardianship
The Will may also be used by parents to vest guardianship over their minor children in trusted individuals. This minimizes the possibility that a dispute may arise over custody of any minor children.
Spousal Support
Traditionally, New Jersey Courts were empowered to order permanent alimony or rehabilitative alimony, or even reimbursement alimony (usually to a spouse who contributed significantly to the acquisition of a higher education of the other spouse) but not alimony for a specifically predetermined period of time.
Legal Separation
Many people contact our firm because they are considering separating from their spouse and they want to know about how to obtain a "Legal Separation". We tell them that there is no such thing in the State of New Jersey as a " Legal Separation"; they can simply move out tonight if they wish to (of course, they cannot simply abandon their responsibilities, both financial and otherwise, for a spouse and children).

Misdemeanors
I just read where a young lady just starting out in REI was charged with selling real estate without a license. She was selling a house she just purchased and was turned in by a real estate agent. Her T/B's (I think this means tenant / buyers) moved out because they became panicked. A real estate investigator talked to her so she sought legal advice. Two attorneys advised her to plead guilty and said it was just a misdemeanor. One attorney said it was a novel case and would take it for a charge of $1,500. She doesn't know what to do. I do not know what the outcome of this case will be. I would bet, if she started with an attorney, she would be suing the real estate agent for filing a false criminal complaint, “torts” and other charges. I do feel empathy for this lady.

I subscribe to Lexis to do my real estate law research. Since I do sell a real estate investing course, it is important to me in keeping knowledgeable of the latest court decisions regarding real estate. Lexis is really for attorneys and is somewhat expensive for the layman to subscribe to. However, since I am a serious professional investor, I feel it is important to stay on top of my profession. Subscribing also cuts down on attorney time if some of the research is done before a consultation. I never advise my students regarding real estate law. But, I might recommend they have their attorney look at a certain case to help them should the occasion arise.

Contact of Sales that are presented through a New Jersey Realtor or a new construction Contract has an automatic 3 day attorney review that permits you to sign in advance of our attorney's review of the Contract. The Contract should be presented to Martin Pankiewicz, Esq. via facsimile immediately after signing to permit the review to be completed within the 3 day period. Contracts between a purchaser and seller where there is no Realtor involved should never be signed until first reviewed and approved by Counsel.
