Traffic Violations
According to a complaint affidavit, the suspect was speeding on the MacArthur Causeway at 1:05 a.m. Oct. 21 when he ran a red light and crashed into the Infiniti, which was operating as a Lyft vehicle, as it was legally making a U-turn on Fountain Street.
Misdemeanors
By accepting the privilege extended by the laws of this state of operating a motor vehicle, you are deemed to have given your consent to submit to an approved chemical or physical test of your breath for the purposes of determining the alcoholic content of your blood, and to a urine test for the purposes of detecting the presence of drugs, if lawfully arrested for any offense allegedly committed while driving or in actual physical control of a motor vehicle while under the influence of alcoholic beverages, chemical substances, or controlled substances. However, you may refuse to take such tests unless you are involved in an accident involving serious bodily injury or death to a human being. However, refusing such tests is not without cost. The law permits the Department of Highway Safety and Motor Vehicles to suspend your privilege to operate a motor vehicle for a period of one (1) year for a first refusal, or a period of eighteen (18) months for a second or subsequent refusal. Additionally, the refusal to submit to a chemical or physical breath test, or to a urine test, upon the request of a law enforcement officer, is admissible in any criminal proceeding against you. Also, if you have previously refused to submit to a breath, blood or urine test, a second or subsequent refusal to submit to such testing is a misdemeanor offense.
Drug Crimes
Bodden was charged with possession of marijuana and drug paraphernalia as well as with the DUI charge. His attorney successfully got the test suppressed as evidence before trial, and Hillsborough County prosecutors appealed. That led to the Lakeland appellate opinion that has stirred up prosecutors statewide, especially those in South Florida, who have the greatest concentration of DUI cases involving drugs.

Manslaughter
Susan Isenberg, president of the Miami-Dade Chapter of Mothers Against Drunk Drivers, said her organization has urged making blood tests mandatory in wrecks with serious injuries because of cases exactly like this one. Last September, a Broward County jury convicted developer Stanley Cameron of manslaughter in a boating accident that killed six people. A blood test taken by the Broward County Sheriff's Department showing he was drunk was key evidence. "It's the only scientific way of proving whether or not a person is impaired,'' she said. ``You can do field sobriety tests but there's always a question if it's accurate.'' The irony, she said, is that Hays might have benefited. "He may have been fine but now it will always be suspect.''
Prostitution
In the city, Warshaw said DUI arrests may have dropped because the department is conducting more roadblocks, prostitution stings, vehicle impoundments and other street operations than before. Those operations may deter drunk drivers, he said.

Property Damage
Xxxxxx went to court Thursday and pleaded no contest to misdemeanor "simple'' DUI. Miami-Dade County Judge Israel Reyes adjudicated him guilty. Sentence: six months' probation, six months' license suspension, and a $750 fine plus $504.75 in court costs. xxxxxxxx, 56, also attended DUI school and agreed to contribute $2,500 to charity. (He picked Catholic Health Services; the Miami Archdiocese is one of his clients.) He also paid restitution to Portocarrero, 46. As part of the deal, the state dropped more serious charges including DUI with [serious] bodily injury and property damage. Prosecutor: Andrea Ricker Wolfson. Defense attorney: Robert Reiff. xxxxxxxxxx obtained a "hardship'' license that allows him to drive for business and other essential purposes.

Immigration Law

Student Visas
Charges changed to Manslaughter without reference to a motor vehicle so he was able to obtain a withholding of adjudication (as he was on a student VISA from japan).

Personal Injury
Any person who causes property damage or personal injury to another while driving under the influence is guilty of a First Degree Misdemeanor (not more than $1,000 fine or 1 year imprisonment).
