Every year, thousands of passengers are injured while vacationing on cruise ships. Many of these injuries occur as a result of negligence on the part of the cruise line. Others, such as cases involving sexual assault or wrongful death, involve far more serious conduct on the part of the cruise line or its employees.
Sex Crimes
Alternative families and delays in having children have become increasingly common, and it is often necessary to involve a lawyer who is familiar with adoption and surrogacy laws, which are rapidly evolving. Mr. Pollack is a parent of two daughters who were conceived through IVF, and he is sensitive to the legal issues and emotional stakes for surrogates, donors, and prospective parents. He can prepare and review egg donor and surrogacy agreements, and he also can advise on medical privacy, insurance coverage, advantages and disadvantages to gestational surrogacy, and other legal issues. We recently represented the widow of a prominent Miami lawyer who sued several former employees to try and recover monies that were misappropriated after her husband died. Through aggressive representation, we were able to reach settlements with all but one of the employees who eventually pled guilty and served time in federal prison for mail and wire fraud as a result of the firm's efforts. We handle defamation claims and business tort cases. In Florida, defamation is a false statement of fact, told to a third party either in writing or verbally, which is intended to harm someone else’s economic or reputational wellbeing. If a plaintiff is considered a public figure, they will need to show that the defendant had actual malice in making the false statement of fact in order to recover damages. Defenses that may be raised include truth, Section 230 of the Communications Decency Act, and the fair reporting privilege. Plaintiffs have two years to bring a defamation claim in Florida. State laws also protect the financial services industry by making it a misdemeanor to defame businesses in that industry. Maritime Law

Workers Compensation
Sanchez-Gutierrez v. Teitelbaum: The firm served as co-counsel representing a young construction worker who died after falling from the 14th floor of a construction site. Initially, it appeared as though the deceased worker's recovery would be limited to the monies available to him under worker's compensation. However, the firm was able to convince the court that the owner of the building was not entitled to worker's compensation immunity because of the circumstances of the case. After several years of litigation, the firm and its co-counsel obtained a well-deserved confidential settlement for the deceased worker and his parents.
Employment Discrimination
Inkel and Palelis v. Aircraft Service International Group: We represented two workers with more than 50 years of combined work experience in an age discrimination claim they filed against their employer after they were fired. Both workers had excellent work histories and received outstanding evaluations from their co-workers and supervisors. The case was filed in federal court, but was settled confidentially before trial. One of the witnesses in the case was so impressed by the Firm's work that he later hired them to represent him in a different case.

Medical Malpractice
In September 2006, the Firm appeared before the Florida Supreme Court on behalf of a 14-year-old girl who suffered a ruptured appendix after a cruise ship doctor failed to properly diagnose her. The trial judge in the case granted summary judgment in favor of the cruise line, holding that the ship was not liable for the medical malpractice of the ships doctor. The Third District Court of Appeals reversed the trial courts decision, and certified the question of whether a cruise line was vicariously liable for the medical negligence of a ships doctor, no passengers, to The Florida Supreme Court. Appearing on behalf of the plaintiff, the Firm argued that the cruise line should be vicariously liable for the medical malpractice committed by its doctor, both as a matter of law and public policy.
