Wrongful Death
$850,000 settlement for wrongful death/pain and suffering for motor vehicle accident for 79-year old woman who was crossing in crosswalk and was struck by vehicle that was backing up to park. Pedestrian suffered fatal injuries including fractured skull, fractured pelvis, multiple rib fractures and fractured clavicle.
Traffic Violations
$1.75 million settlement for motor vehicle accident for 72-year old motorist who suffered fractured cervical vertebrae requiring cervical fusion and fractured hip requiring surgery with open reduction and internal fixation, who claimed that the defendant’s vehicle was speeding around a blind curve into the intersection; and the defendant argued that our client failed to obey a stop sign before entering the intersection.

Workers Compensation
$1.85 million settlement for motor vehicle accident for 53-year old man who was a front-seat passenger in a van that struck a stopped dump truck in the rear. Our client instinctively reached out and placed his right hand on the dashboard in anticipation of the impending collision; and the van’s airbag deployed on impact, with the airbag making direct contact with his hand. As a result, our client sustained open, segmental fractures of both the radius and ulna, requiring surgery with open reduction and internal fixation for this both-bone forearm fracture, with restriction of motion of the fingers and thumb of his right hand, and with resulting limited motion and pain of his right shoulder, with consequential adhesive capsulitis (“frozen shoulder”). Although our client was in a company van being driven by his co-worker, he was not precluded from suing his employer (the owner of the van) or his co-worker (the driver of the van) because he was in the process of being driven home after his work was completed, and he did not seek or receive workers compensation benefits.

$2.21 million settlement during trial for catastrophic injuries for premises liability for 25-year-old woman working as live-in nanny who was exposed to toxic acetone fumes when employer’s home was cleaned (without her knowledge) to remove paint. She suffered toxic demyelination of the brain.

Medical Malpractice
$6.2 million settlement for medical malpractice for 49-year old woman who underwent relatively routine abdominal surgery for subtotal colectomy with ileosigmoidostomy for recurrent diverticulitis. During this procedure she developed a volvulus of the small intestine which effectively cut off the blood supply to the small intestine and caused the distal 2/3’s to become enviable. This necessitated the removal of most of her small intestine with resulting short gut syndrome which required combined small intestine and pancreas transplant.
