Premises Liability
On September 25, 2020, Mary Jaye Hall and Thomas Suri obtained final summary judgment on behalf of their Hospital client. This was a premises liability action in which the plaintiff alleged the Hospital failed to safely maintain outside walkways, which caused the plaintiff to fall and injure herself. Mary Jaye Hall and Thomas Suri argued that the plaintiff had failed to present any evidence that an unsafe condition existed regarding the walkway. The trial court agreed and held the hospital was entitled to summary judgment in its favor as a matter of law.

McCall v. U.S. held that the statutory cap on wrongful death noneconomic damages is unconstitutional. It is important to note that the court in answering this question rephrased it and limited it to cases of wrongful death. The damages on cap is apparently still in place for other allegations of medical malpractice causing personal injury.
